Judge Williams Declares a Mistrial in the Case Against Officer Porter

Baltimore defense attorney and former prosecutor, Andrew I. Alperstein was quoted in a recent CNN article regarding the impact of Officer Porter’s mistrial on the entire Freddie Gray case. Officer Porter was the first of six officers to stand trial for charges in connection with the death of Freddie Gray.

Mr. Alperstein noted,”Had he [Officer Porter] been convicted, the state could have tried to ‘flip’ him to testify against the other officers. Had he [Officer Porter] been acquitted, he could have been ‘forced to testify’ as what’s called ‘a compellable witness’…This hung jury is … a major setback for the state because they have neither option available.”
