Washington Post Gains Legal Insight from Warren Alperstein

The highest-ranking officer charged in the arrest and ultimate death of Freddie Gray has become the third to waive his right to a jury trial, choosing instead to leave the decision to Judge Barry Williams.

When asked by the Washington Post to provide insight into this development, Baltimore Defense Attorney Warren Alperstein said that the previous rulings issued by Judge Williams have left state prosecutors scrambling. “Unless the state can prove beyond a reasonable doubt that Lieutenant Rice, being a supervisor, had a better understanding of the risks of not restraining Freddie Gray than the van driver, then the state will very likely fail to convict him as well,” Alperstein said.
